Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Mizton (“Mizton,” “we,” “us”) and govern your use of Miztrace (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Miztraceadds open- and click-tracking to emails you send from Gmail and, optionally, sends campaign emails on your behalf through Google’s Gmail API. We may change, suspend, or discontinue features at any time.

2. Accounts

You must provide accurate information and are responsible for keeping your account credentials and connected Google account secure. You are responsible for all activity under your account. You must be at least 16 years old to use the Service.

3. Acceptable use

You agree that you will not, and will not permit anyone to:

• Send unsolicited bulk email (spam) or otherwise violate anti-spam laws such as the US CAN-SPAM Act, the EU GDPR/ePrivacy rules, or Canada’s CASL. You are solely responsible for having a lawful basis and any required consent to email your recipients and to track opens and clicks where the law requires it;
• Use the Service to send unlawful, harassing, deceptive, infringing, or malicious content;
• Track individuals in a way that is unlawful in their jurisdiction, or conceal your identity as the sender;
• Abuse, reverse-engineer, overload, or attempt to gain unauthorized access to the Service or to Google’s APIs;
• Violate Google’s applicable terms, including the Gmail API program policies.

We may suspend or terminate accounts that violate these rules or that put the Service or our API access at risk.

4. Subscriptions, billing, and refunds

Paid plans are billed in advance through our payment processor, Stripe, on a recurring (monthly or yearly) basis until cancelled. By subscribing you authorize recurring charges. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period and you retain access until then. Except where required by law, payments are non-refundable. We may change pricing with reasonable notice.

5. Your content

You retain ownership of the content you create or upload (templates, signatures, campaigns, media). You grant us a limited license to host and process that content solely to operate the Service. You are responsible for your content and for ensuring you have the rights to use it.

6. Intellectual property

The Service, including its software, design, and trademarks, is owned by Mizton and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.

7. Third-party services

The Service relies on third parties such as Google, Stripe, and others. Your use of those services is subject to their terms, and we are not responsible for them. See our Privacy Policy for the sub-processors we use.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind. Email tracking is inherently imperfect: mail clients, image proxies, privacy features (such as Apple Mail Privacy Protection), and security scanners can cause missed or false opens. We do not warrant that tracking results are complete or accurate, or that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Mizton will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

11. Governing law

These Terms are governed by the laws of [Jurisdiction — e.g. Delaware, United States], without regard to conflict-of-laws principles. The courts located in [Jurisdiction — e.g. Delaware, United States] will have exclusive jurisdiction, unless mandatory local law provides otherwise.

12. Changes to these Terms
